Terms of Service
These terms govern your use of DTCQuiz (the “Service”) operated by the Service operator (“we,” “us”). By engaging with us commercially (signing a SOW, paying an invoice, or operating a tenant on the platform), you agree to these terms. If you don't agree, please don't use the Service.
1. What we provide
A custom-built quiz funnel hosted under your tenant subdomain on dtcquiz.com (or a custom domain you provide), plus the dashboard, agent integrations, and analytics that ship with it. The relationship is a productized service: we build, host, and operate your funnel; you direct content and commercial decisions.
2. Brand obligations
You agree to:
- Provide accurate information about your brand, products, and audience.
- Comply with applicable laws when collecting leads (CAN-SPAM, GDPR, CCPA, etc.) — including but not limited to obtaining consent where required.
- Not use the platform for content that is unlawful, deceptive, infringes third-party rights, or is otherwise restricted by Stripe, Shopify, or the payment networks downstream of your funnel.
- Keep your API keys, dashboard credentials, and OAuth tokens secure. You are responsible for activity under your account.
3. Payment
Pricing and payment terms are agreed in writing for each engagement (typically a fixed setup fee + monthly retainer, invoiced manually). Invoices are due within 14 days. Overdue accounts may have the funnel suspended after written notice.
4. Data ownership
You own the data your quiz collects: leads, quiz responses, events, conversions. We hold it on your behalf and use it only to operate the Service and produce the analytics in your dashboard. We will not sell, rent, or share it with third parties beyond the sub-processors listed in the Privacy Policy.
5. Intellectual property
The platform itself — code, schema, themes — remains our intellectual property. The custom theme we build for your brand is licensed to you for use on your tenant under the duration of the engagement. The brand content you provide (logos, copy, products) remains your property.
6. Availability + service levels
We target high availability but make no formal SLA at this stage of the product. Scheduled maintenance is announced in advance where possible. Unscheduled outages will be communicated and addressed promptly during business hours.
7. Confidentiality
Each party will treat the other's non-public information as confidential and use it only for the purpose of the engagement.
8. Termination
Either party can terminate with 30 days' written notice. On termination we will: deactivate the tenant, provide an export of your leads and analytics in CSV, and delete the rest within 30 days unless you ask us to retain it. Annual pre-payments are non-refundable for the balance of the term unless we materially breached these terms.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. Neither party will be liable for indirect, incidental, consequential, or punitive damages.
10. Warranty disclaimer
The Service is provided “as is.” We disclaim all implied warranties including merchantability and fitness for a particular purpose. We do not warrant that the Service will be uninterrupted or error-free.
11. Governing law
These terms are governed by the laws of the jurisdiction in which the Service provider is principally established. Any disputes will be resolved in the courts of that jurisdiction.
12. Contact
DTCQuiz is currently in private beta and does not publish a contact email. Active brand operators should reach out via the channel they were onboarded on.
